Article 51 of the TFEU provides that the application of provisions related to internal market freedoms may be limited insofar as the exercise of official authority is concerned. The provisions of the said article were adopted by a number of Member States, Poland amongst them, who decided - subsequently thereto - that access to the notary public profession shall be limited to their nationals. While the Commission took a different stand on this issue, a dispute arose between the Commission and Member States.
