The aim of the article is to present the basic ideas of the Bill on preventing insolvency and introducing consumer bankruptcy proposed by the members of the V Polish Parliament. The Bill is meant to prevent social exclusion due to the inability of an individual to pay massive debts and falling into the credit trap when although he/she tries to pay off the main credit the rates keep growing faster. It is bad not just for the individual but also for his creditors especially those that were not the first to start vindicating. The consumer bankruptcy is meant to ensure just vindication for all the interested parties as well as prevention of social exclusion. In order to prevent the abuse of the bill it is a public procedure and it is highly limited to one in lifetime use.
