Článek se u příležitosti 150. výročí narození Emanuela Tilsche (1866–1912) zabývá nejen jeho životní a profesní dráhou, ale také významem pro současnou civilistiku. Tilschova bibliografie sice není nijak obsáhlá, přesto ho můžeme považovat za jednoho z nejpodnětnějších autorů česko-rakouské právní vědy.Dodnes na něj odkazuje odborná literatura i judikatura a jeho názory zřejmě stály v pozadí či alespoň spoluovlivnily také řešení některých zásadních otázek nedávné rekodifikace (např. autonomie vůle a univerzální sukcese v dědickém právu). K podrobnějšímu rozboru témat, u nichž bylo, je či může být jeho dílo inspirativní, jsme vybrali problematiku zásad, věci v právním smyslu a vlastnictví práva, součásti a příslušenství věci, univerzální sukcese a pozůstalosti, spolužijících osob, a nabytí dědictví.

The paper, on the occasion of the 150th birth anniversary of Emanuel Tilsch (1866–1912), deals with his live, work and importance for Czech civil law jurisprudence. The bibliography of Tilsch is not rich, and yet he is one of the most influential authors of Czech-Austrian jurisprudence. Even today he is still referred to in literature and jurisprudence, and his views were apparently behind the recent recodification or contributed to the solution of some fundamental questions (e.g. autonomy of will and universal succession in the inheritance law).We chose to revisit the topics which are or could be still inspirational, that is the questions of principles, things in the legal sense and ownership of law, component and accessory of things, universal succession and inheritance, cohabiting persons, and acquisition of inheritance.
