Agency-Based Temporary Work and European Union Regulations

At the beginning of 80s the European Parliament and the Council started to take action so as to create regulations, which could ensure that temporary agency workers were well protected. In the presentation of proposal for a Directive on temporary workers, the European Commission emphasized the role of quality and popularity of temporary agency work among workers and job seekers. The proposal for a Directive on temporary workers was not adopted because of difficulties in finding the right balance between protecting temporary agency workers and providing sufficient flexibility in the labour market, while at the same time respecting the different practices and traditions at national level. The main problem is the principle of equal treatment. In the half of the year 2004, Poland joined the minority blocking the proposal for a Directive. The position of Polish negotiators is inconsistent with Polish Act on employing of temporary workers. But this position is reasonable because of future plan to make Polish regulations more flexible.
