Příspěvek reaguje na téma zneužití práva, jak je v poslední době traktováno doktrínou a prakticky promítáno do reálného života práva. Autor usiluje tendence směřování zneužití práva zasadit do širšího rámce geneze tohoto institutu a zachytit jeho osud v dlouhodobé perspektivě od římského práva do současnosti a budoucích výhledů. Prezentuje vývojovou linii zneužití, která vedla od popírání možnosti právně zamezit jakémukoli jednání, k němuž došlo při výkonu subjektivního práva, až k hypertrofii konstrukce zneužití, která je uplatňována nejen při výkonu absolutních práv, kam původně náležela, ale v celém soukromém a v posledních desítiletích i veřejném právu. V tomto rámci se zabývá rovněž znaky skutkové podstaty zneužití.

This contribution responds to the development of the topic of the abuse of law, mentioned recently by the doctrinal discourse, but more frequently used by the judicial practice. The author tends to place the actual tendencies in this direction within the broader frame of its genesis and to describe its destiny from the historical view (from Roman Law till now, incl. view into the future). The author presents the course of the development of the abuse of law from the absolute denial of the abuse of law to the position of ubiquitous universal principle, used not only in the branche of private law, but recently also in the public law relations. Within this general scope, the conceptual attributes of the abuse of law are considered.
