Koncepce "Práva dítěte" zdůrazňuje, že děti, které byly tradičně předmětem ochrany ve smyslu "nejlepšího zájmu dítěte", získávají podstatně aktivnější roli. Uskutečňování mezinárodních smluv, zejména Úmluvy OSN o právech dítěte z roku 1989, Evropské úmluvy o výkonu práv dítěte z roku 1996 a Listiny základních práv Evropské unie z roku 2000, a navíc národní ústavněprávní ochrana, mají zásadní význam pro vztahy mezi rodiči a dětmi, rodičovství, autonomii dítěte a rodičovskou odpovědnost v právních řádech evropských států. Rozvoj práva dítěte na aktivní účast v rodinněprávních soudních řízeních je dalším krokem vpřed ve smyslu vytváření evropského soudnictví, jež je k dětem přátelské.

The concept of "rights of the child" stresses that children, instead of being primarily objects of protection as under the traditional "best interests of the child" approach, are to be given a more active role. The implementation of Conventions, particularly the UN Convention on the Rights of the Child of 1989, the European Convention on the Exercise of Children’s Rights of 1996 and the European Charter of Fundamental Rights of 2000, as well as national constitutional protection has had a deep impact on parent-child relations, parentage, the autonomy of the child and parental responsibilties in the family law of European countries. Promoting the right of the child to be heard and to participate in family proceedings marks another step forward in the right direction of creating child-friendly justice in European jurisdictions.
