Celem niniejszego tekstu jest identyfikacja i analiza zasadniczych różnic między własnością intelektualną a materialną. Na tej bazie udzielana jest odpowiedź na pytanie, czy refleksje dotyczące klasycznie pojmowanej własności mogą być – a jeśli tak, to w jakim zakresie – ekstrapolowane na własność intelektualną. Z uwagi na rosnące znaczenie własności intelektualnej dla dzisiejszej gospodarki konieczne jest także poszukiwanie odpowiedzi, w jakich aspektach dwie tytułowe kategorie mogą się do siebie upodobnić, a w których konieczne jest wykorzystanie zupełnie odmiennych mechanizmów. Ekonomiczna analiza prawa jest dokonywana w niniejszym tekście na przykładzie patentu.

The aim of this paper is to identify and analyse the major differences between intellectual property and tangible property. The article provides the answer to the question: whether considerations on the tangible property can be – and if so, to what extent – extrapolated to intellectual property. Due to the growing importance of intellectual property for contemporary economy, it is also necessary to find answers in which aspects these two categories can be conformed, and where it is necessary to use a completely different mechanisms. Economic analysis of law in this text uses the example of a patent.
