The paper contains the introductory remarks delivered by the author at the opening of conference consecrated to legal problems of commerce of agricultural holdings which took place at Milówka in May 2009. The regulation in question, very well developed in Poland in the period 1960–1990, actually is in full decline – reduced to some articles dispersed at random in different legal acts. The actual legislative works of ministerial commission which prepare the new version of Polish Civil Code had opened again the problem of the unification and revision of the regulation in question . The author realizes the fact that in Polish doctrine there is no unanimity concerning the control of commerce of agricultural holdings. The opinions vary from the postulate of very rigorous control to the postulate of free trade of agricultural holdings. The critical analysis of every opinion brings the author to the conclusion that the postulate of introducing more rigorous control of commerce of agricultural holding is in accordance with EU structural policy and is to interest of Polish agricultural structures and their amelioration.
