Artykuł opisuje sytuację, jaka zaistniała w trakcie VII kadencji Sejmu RP w odniesieniu do spółdzielni uczniowskich. W ramach sejmowej Komisji Nadzwyczajnej do rozpatrzenia projektów ustaw z zakresu prawa spółdzielczego, po raz kolejny nie uwzględniono części szczegółowej zawartej w poselskim projekcie ustawy Prawo spółdzielcze (Sejm Rzeczypospolitej Polskiej VII kadencja - Druk Sejmowy Nr 980), w tym założeń dotyczących spółdzielni uczniowskich. Argumentację co do decyzji o odrzuceniu wskazanej części projektu posłowie oparli na stwierdzeniu, iż problematyka poszczególnych typów spółdzielni, w tym spółdzielni uczniowskich, powinna być regulowana w odrębnych ustawach. Autorzy przypominają zatem stanowisko większości sejmowej co do rzeczonej problematyki z roku 2011, kiedy to toczyła się debata nad projektem ustawy o spółdzielniach uczniowskich. Sejm zdecydował wówczas o jego odrzuceniu już w I czytaniu, wskazując, że regulacja ta powinna zostać włączona do ustawy Prawo spółdzielcze w części szczegółowej, a więc w takiej formie, w jakiej ukształtowano najświeższy projekt poselski odrzucony, mimo, iż jest przychylny wobec żądań posłów z 2011r. W rezultacie brak jest obecnie uregulowań ustawowych dotyczących spółdzielni uczniowskich. Mimo ich wyjątkowej specyfiki spółdzielnie uczniowskie obecnie działają na zasadach ogólnych ustawy Prawo spółdzielcze oraz na podstawie porozumienia wypracowanego przez Ministerstwo Edukacji Narodowej i Krajową Radę Spółdzielczą, które określa wzorcowy statut takiej spółdzielni i definiuje ją jako organizację wewnątrzszkolną, bez osobowości prawnej.

The article describes the situation that occurred during the seventh term of the Republic of Poland’s Sejm in relation to students’ cooperatives. Within the framework of the Parliamentary Special Committee to consider draft laws in the field of cooperative law, once again the part containing the draft legislation Cooperative Law (Polish Sejm term VII – Sejm Print No. 980), including assumptions about the students’ cooperatives, was not considered. The argument for the decision to reject that part of the project, deputies relied on the assertion that the issue of individual types of cooperatives, including students’ cooperatives, should be regulated by separate laws. Therefore the Authors remind the attitude of parliamentary majority regarding this issues from 2011, when the debate on the draft law on students’ cooperatives was conducted. Parliament then decided to reject it in the first reading, indicating that this regulation should be included in the detailed part of Cooperative Law, and therefore in the form in which the most recent parliamentary draft was formed, rejected although it is compatible with the demands of deputies from 2011. As a result, there is currently no statutory regulations on students’ cooperatives. Despite their special character students’ cooperatives currently work on a general basis of Cooperative Law and on the basis of agreement reached by the Ministry of Education and the National Cooperative Council, which sets the model statute of a students’ cooperative and defines it as an organization within school, without legal personality.
