The European Court of Human Rights, in its judgement of 28 November 2023 in the case of Krachunova v. Bulgaria, ruled that Bulgaria had violated the provisions of the European Convention for the Protection of Human Rights and Fundamental Freedoms due to its refusal to recognise the compensation claim of the applicant, who was a victim of human trafficking. The Court found that, under Article 4 of the Convention, States have an obligation to ensure that victims of human trafficking have the possibility to seek compensation for material benefits unlawfully gained by pimps.
