Artykuł stanowi analizę funkcjonalną i normatywną zjawiska własności intelektualnej i jej ochrony w związku z rewolucją technologiczną wynikającą z masowego wykorzystania Internetu i technologii mu towarzyszących. Autor dokonuje analizy własności intelektualnej w ujęciu zasobowym i przedstawia wyniki własnych badań dotyczących udziału wynagrodzeń uprawnionych w korzyściach z tytułu rozporządzania tym kapitałem. Autor zwraca uwagę na konflikt interesów indywidualnych i społecznych w sferze ochrony własności intelektualnej. Podkreśla też zmiany zachodzące strukturze korzystania z własności intelektualnej i wskazuje na ich konsekwencje. W artykule wyjaśniono mechanizm negatywnego wpływu obecnego systemu ochrony własności na warunki ekonomiczne rynków nauki i kultury oraz zasygnalizowano koncepcję nowej architektury ochrony własności intelektualnej.

The article is a functional and normative analysis of the phenomenon of intellectual property and its protection in connection with the technological revolution stemming from the mass use of Internet and the accompanying it technologies. The author performs an analysis of the intellectual property in terms of resources and presents findings of his own surveys concerning the share of eligible remunerations in benefits on account of that capital disposition. The author pays attention to the conflict of individual and public interests in the sphere of intellectual property protection. He also emphasises the changes taking place in the structure of usage of intellectual property and points out to consequences thereof. In the article, he explained the mechanism of negative impact of the present system of property protection on the economic conditions of the markets for science and culture as well as he signalled the concept of new architecture of intellectual property protection.
