Zgodnie z ustawą o utrzymaniu czystości i porządku w gminach (tj. Dz. U. z 2013 r . poz. 1399 z późn. zm.) zwanej dalej ustawą o ucipwg, miasto (w omawianym artykule m. st. Warszawa) ma obowiązek odbierania odpadów komunalnych od właścicieli nieruchomości. Obowiązek w tym wypadku jest obustronny – zarówno miasto musi odebrać odpady komunalne – tak jak i właściciel nieruchomości musi takie odpady przekazać firmie, która wygrała przetarg na odbiór odpadów komunalnych. M. st. Warszawa podjęło decyzję w uchwale rady nr XXXVII/949/2012 o odbieraniu odpadów także z nieruchomości, na których nie zamieszkują mieszkańcy a powstają odpady komunalne – czyli z firm.

According to the law on maintaining cleanliness and order in municipalities (i.e. Journal of Laws of 2013, item 1399 as amended), hereinafter referred to as the ‘oucipwg’, a town/city (in this article the Capital City Warsaw) is required to collect municipal waste from property owners. The obligation in this case is on both sides - the city must collect household waste and the property owner has to pass waste to the company that won the tender for waste collection. The Capital City Warsaw decided in the council resolution No. XXXVII/949/2012 also to collect waste from properties which are not inhabited by residents but municipal waste is generated there, i.e. from companies.
