Participation in building water pipe infrastructure and sewage system by private investors. The main problem of this article centers around the issue related to access to devices, serving to a purpose of water supply and draining off waste. The act concerning this issue imposes the requirement of providing an appropriate infrastructure for water supply and draining off waste on public utility enterprise or commune. However, when public entities do not plan investments connected with the building of proper infrastructure, one should consider, whether private people have the possibility to finance building of necessary devices. In accordance with judicial opinions, financing investments in water pipe infrastructure by private investors is not allowed on the basis of legal regulation in force. Moreover, the Act on Real Estate Management defines institution, which enables to collect a charge for increase in the value of real estate after completing the construction of the water pipe lines. Nevertheless this institution do not ensure effective participation in financing of infrastructure development by private investors. In connection with the above it seems that it should be introduced regulation, which enable concluding contracts, concerning financial participation in building infrastructure by private investors and also necessary protection of customers.
