Currently applicable regulations of the Penal Code do not provide for – in the light of the uniform and well established interpretation of Art. 212, Art. 216 and Art. 226 of the Penal Code – penalization of an offense such as public defamation (insulting) of a deceased public official in connection with performance of his official duties. The purpose of this article is to show that the scope of protection of public officials (leading to the exclusion of penal protection of deceased public officers) is incompatible with the systemic interpretation and teleology of the substantive penal law, and above all, violates the Constitution of the Republic of Poland (in particular Art. 1, Art. 2, Art. 30, Art. 31 paragraph 3, Art. 32, Art. 47 and Art. 82 of the Constitution).
