The subject of this article is an analysis of the Act of 22 July 2022 amending the Prison Service Act and certain other acts, which gave the Prison Service the power to apply inve¬stigative operations. The author makes a brief introduction on the specifics of investiga¬tive operations of the Prison Service and based on the views of doctrine representatives, discusses their essence in general. Then, based on the jurisprudence of the European courts and the Polish Constitutional Tribunal, he discusses the standards of application of investigative operations in a democratic state of law. The article also analyses the position and role of a new authority within the Prison Service - the Internal Inspectorate of the Prison Service, as well as the power to apply investigative operations. It concludes by pointing out opportunities and threats in relation to those changes and makes a pre-liminary assessment, also pointing out the need for later verification.
