En el trabajo se da cuenta de los programas de algunos partidos políticos, se analizan sus propuestas sobre las relaciones entre el Estado y la Iglesia Católica. Con esta premisa se vislumbra cuál puede ser el futuro de los Acuerdos iglesia-Estado. La denuncia de los Acuerdos tendría consecuencias respecto a la protección de los lugares de culto y a la inviolabilidad de archivos, registros y demás documentos, ya que supondría un ataque frontal a la autonomía organizativa y a la especificidad de lo sagrado dentro de la Iglesia. La asistencia religiosa es fundamental, es una manifestación clara del derecho de libertad religiosa, tanto individual como comunitario. Los poderes públicos han de reconocer, promover y garantizar el derecho de libertad religiosa de las ¾ partes de los españoles que se autodefinen como católicos. No pueden entenderse como privilegios, lo que son manifestaciones de un derecho fundamental.

In the second article in the series “The future of the agreements between Spain and Holy See” R. Berenguer Beneyto, a professor of law on religion at the University CEU in Valencia, analyzes the programs of political parties, presented before the elections in December 2015 concerning the places of worship and religious service where are faithful. He discusses that negating of the existing agreements which occurs in these programs – in presented issue – is threatening the protection of places of worship, the inviolability of archives, registers and other documents of religious communities, because in some of these a full-scale attack on the organizational autonomy is assumed, and even on what is connected with sanctifying in the Church. Also it is not possible to agree with negating of the existing guarantees for the religious service in hospitals, prisons, nursing homes and other places, where are believers. The possibility of religious assistance in these places is a clear manifestation of respecting the right of religious freedom, individually or in the community. Public authorities are supposed to recognize, promote and guarantee the right of religious freedom of Catholics - ¾ of the Spanish population. Existing guarantees should not be understand as privileges, because they are a manifestation of the fundamental law. The statements that the guarantees of the religious service in such places towards those who want it are to be abolished, because the religious service can disturb the peace of unbelieving or non-practicing, is a simply manifestation of demanding the religious secular state.

W drugim artykule z cyklu „Przyszłość układów zawartych przez Hiszpanię ze Stolicą Apostolską”, R. Beneyto Berenguer, profesor prawa wyznaniowego z Uniwersytetu CEU w Walencji, analizuje programy partii politycznych, zaprezentowane przed wyborami w grudniu 2015 r., w odniesieniu do miejsc kultu i posługi religijnej tam, gdzie znajdują się wierni. Podnosi, że istniejące w tych programach negowanie obowiązujących układów – w interesującej nas materii – zagraża ochronie miejsc kultu, nienaruszalności archiwów, rejestrów i innych dokumentów wspólnot religijnych, ponieważ w niektórych zakłada się frontalny atak na autonomię organizacyjną, a nawet na to, co związane jest z uświęcaniem w ramach Kościoła. Nie można też zgodzić się z negowaniem istniejących gwarancji dla posługi religijnej w szpitalach, więzieniach, domach opieki i innych miejscach, gdzie przebywają wierzący. Możliwość asystencji religijnej tamże jest jasną manifestacją poszanowania dla prawa wolności religijnej, z której korzysta się indywidualnie lub wspólnotowo. Władze publiczne mają uznawać, promować i gwarantować prawo do wolności religijnej także katolików – ¾ ludności Hiszpanii. Istniejących gwarancji nie należy pojmować jako przywilejów, gdyż są manifestacją prawa podstawowego. Twierdzenia, że gwarancje posługi religijnej w takich miejscach wobec tych, którzy sobie jej życzą mają być zniesione, bo sprawowanie posługi może naruszać spokój niewierzących lub niepraktykujących, jest wręcz przejawem żądania państwa wyznaniowego laickiego.
