The author discusses selected conditions for creating law after the political transformation in Poland. In a democratic state ruled by law, the law is a real and important regulator of social and political relations, which in turn leads to the fact that there are more and more regulations, while the logic of the political system that was shaped after 1989, often requires quick and unfortunately not always refined changes in legal regulations. Although the law expresses some autonomous values, its instrumental use was not entirely avoided. These circumstances do not explain the lawmakers of bad law, but they certainly create a number of challenges for the legislators, which certainly did not exist before 1989. The picture of contemporary legislation is also complemented by a flawed – as it seems – model of the implementation of the second law of the European Union, which contributes to deepening inconsistencies within the national legal system.
