The subject of the analysis concerns legal aspects of food security and food safety. These two terms, even though similar in wording, have quite different meanings. Both terms refer to the highest, legally protected values: health and life. They differ, however, in their importance in the legal system. The purpose of the study was to define the content and mutual relations between the two terms. Food safety and food security are coupled with legal obligations to secure them, but the decision how this objective is to be achieved remains a political choice. However, although the failure to secure food safety is subjected to multiple administrative or penal sanctions, the deficiency in food security (security of supply) may entail the political responsibility and sanctions. It seems that the relationship between the term ‘food security’ and ‘food safety’ takes the form of coexistence that may lead to identical results in the event of a failure to secure them. Food security opens up the ways to ensure food safety, while even if the food security were in place, but the food were unsafe and hazardous to human health, its consequences might lead to the same effects as those caused by food insecurity, just in a different way.

Le considerazioni hanno per oggetto gli aspetti giuridici della sicurezza alimentare e igiene degli alimenti. I concetti elencati condividono un comune denominatore – la sicurezza dei consumatori. Tuttavia essi hanno differenti significati. Ognuno di essi fa riferimento ai valori fondamentali tutelati dalla legge: la salute e la vita. Ma diverso è il loro peso nel sistema giuridico. Lo scopo delle considerazioni è, tra l’altro, un tentativo di determinare il contenuto di questi concetti e il rapporto tra di loro. Alla sicurezza alimentare e igiene degli alimenti sono connessi gli obblighi giuridici volti a garantirle. Nella sfera della decisione politica rimangono il modo e la forma della loro attuazione. Se, tuttavia, la mancata garanzia dell’igiene degli alimenti è soggetta a una serie di sanzioni amministrative oppure penali; alla mancata garanzia della sicurezza alimentare (sicurezza dell’approvvigionamento) possono essere collegate la responsabilità e le sanzioni politiche. Pare che il rapporto fra i termini food security e food safety sia una coesistenza che, nel caso della loro violazione, potrebbe portare all’identità delle conseguenze. La food security apre possibilità di soddisfare il fabbisogno alimentare e di garantire la sicurezza alimentare. Per contro, la food safety, anche se la sicurezza alimentare rimane garantita, se il cibo fosse dannoso per la salute, potrebbe portare alle conseguenze identiche alla food insecurity, ma in modi diversi.
