The objective of this study is to discuss the conditions to be met by a person employed as a teacher in public schools and the establishments subordinate to the local government units. The analysis of the issue in question was based on the regulations of law existing in this area, reference works and judicial practice. The study discusses general conditions and individual indications to establish an employment relationship with a teacher. The legislator introduced specific criteria to be fulfilled by a person employed as a teacher, which require referring to various branches of law. The definition and the regulation by law of certain requirements to be employed as a teacher arouses doubts, confirmed in numerous judicial decisions. In the doctrine there are few publications dedicated to the subject of an employment relationships with teachers. The rich case-law of the Supreme Court refers to an employment relationships with teachers, in particular to the provisions amended on numerous occasions, but it is not exhaustive. The legal regulation of employment for teachers is not, however, in many cases, precise and arouses doubts as to how to interpret them. This study aims to demonstrate these doubts and attempts to explain them.
