W artykule przedstawiono regulacje prawne w zakresie zatrudniania obywateli państw trzecich w Polsce, procedury nadzorcze oraz orzecznictwo sądowoadministracyjne w przedmiotowym zakresie z uwzględnieniem wykonywania pracy przez obywateli państw trzecich pełniących funkcje w zarządach osób prawnych, które uzyskały wpis do rejestru na podstawie przepisów o Krajowym Rejestrze Sądowym lub są spółkami kapitałowymi w organizacji. Wskazano również na konieczność ujednolicenia przepisów materialnych i proceduralnych oraz na wprowadzenie jasnych i czytelnych zasadnastawionych, z jednej strony, na zwalczanie i zapobieganie nielegalnej imigracji, z drugiej zaś sprzyjających prawidłowemu traktowaniu obywateli państw trzecich legalnie przebywających i pracujących w Polsce. Ponadto zwrócono uwagę na doniosłe znaczenie w zakresie interpretacji i stosowania przepisów dotyczących zatrudniania obywateli państw trzecich w Polsce wykonywanych przez sądy administracyjne. W zakresie orzecznictwa wskazano na wiele nieścisłości proceduralnych, jak również na błędy interpretacyjne.

The article presents legal regulations in the scope of an employment of the third-country citizens in Poland, supervisory procedures and administrative law jurisdiction within objective scope including work performance of the third-country citizens holding positions on the boards of legal persons, which have been registered under the provisions of the National Court Register or are limited companies in the organization. The study also points the need of harmonization of substantive and procedural rules as well as an introduction of clear and transparent rules aimed at one hand, combating and preventing illegal immigration and on the other hand, promoting a proper treatment of thirdcountry citizens legally residing and working in Poland. In addition, a crucial role of interpretation and adaptation of rules related to the employment of the third-country citizens in Poland carried out by the administrative courts, was emphasized. In the case of administrative jurisdiction, a number of procedural inconsistencies were identified as well as interpretation errors.
