W opracowaniu przedstawiono analizę prawa unijnego dotyczącego równego traktowania w systemach ustawowych i zawodowych zabezpieczenia społecznego ze szczególnym uwzględnieniem systemów emerytalnych. W tym celu przedstawiono, ustalone w literaturze oraz orzecznictwie europejskim, pojęcie i zakres filarowości w odniesieniu do prawa UE z tego zakresu. Zagadnienia te omówiono na podstawie orzecznictwa TS UE.W szczególności przedstawiono analizę wyroku C-559/07, mającego istotne znaczenia dla ustalania kryteriów prawnych systemów objętych postanowieniami dyrektywy 79/7/WE albo wchodzących w zakres art.141TWE (obecnie 157 TFUE).Ustalenia te są także istotne dla oceny przestrzegania zasady równego traktowania w systemach emerytalnych w prawie krajowym.

The paper presents an analysis of EU law on equal treatment in statutory and occupational social security with particular emphasis on pension systems. For this purpose, set, set in the literature and European case law, the concept and scope of pillar in relation to EU law in this area. These issues are discussed on the basis of EU law TS. In particular, an analysis of the judgment C-559/07, having significant importance for determining the legal criteria for schemes covered by the provisions of the Directive 79/7/WE or within the scope of art. 141 TEC (now 157 TFEU). Findings are also relevant for the assessment of compliance with the principle of equal treatment in pension schemes in national law. Arrangements were made to induce the effects of EU regulations and the case law of the Polish social security law.
