W artykule zawarto analizę prawa UE dotyczącego zatrudnienia czasowego. Ustalono jego konsekwencje dla ustawodawstwa krajowego. Przedstawiono wyrok ETS w sprawie C-38/13, w którym Trybunał uznał, że polskie regulacje kodeksu pracy różnicujące długość okresu wypowiedzenia umów o pracę na czas określony i nieokreślony za niezgodne z prawem UE –dyrektywą Rady 99/70/WE. Orzeczenie to może mieć istotne znaczenie dla dalszej praktyki zatrudnienia pracowników na czas określony.

The text contains an analysis of the EU law on temporary employment and presentes its implications for the national legislation. It also discusses the sentence of the ECJ in Case C-38/13, in which the Court stated that the fact that Polish labour code regulations on the length of the termination of employment contracts, distinguishing between a permanent and temporary employment is incompatible with the EU law – Council Directive 99/70/ EC. The sentence may have important implications for further practice to employ staff on fixed periods.
