Mortgage registers are very important in the real estate transactions in Poland and in Germany. Every interested person is allowed to view this register. Publicness of mortgage register would not have any meaning if there would not be the pledge of the guarantee of public credibility. This institution protects reliance in entries of mortgage register and facilitates the transactions of real estate. During regulations of public faith warranty, legislator had to settle an essential issue. The question presented is what would happen, if the legal status is different than the status given in mortgage register. Should rather the content of the register be more important? Pledge of The guarantee of public credibility has favorable infl uence on real estate transactions, but may also cause situation in which authorized person would lost property without any guilt.
