This paper is an analysis of the draft regulation of the European Parliament and the Council on novel food in order to establish whether it contains sufficient legal solutions enabling to achieve the proposed objectives and basic goals, both protective and economic. The advantages as well as the disadvantages are noted. The greatest advantage is a simplified, shortened and centralised system of procuring general certificates that enable the marketing of novel food. The proposals of special solutions in dealings with novel food originating in third countries are also noteworthy. What still remains and needs to be addressed, is the future regulation which must ensure clarity and adequacy of provisions in such a way that on the one hand they will take into account the highly innovatory level of food industry, but on the other hand they will provide adequate protection of consumers’ health and interests, as well as efficient functioning of the internal market.

L’oggetto dell’analisi è una proposta di regolamento del Parlamento europeo e del Consiglio in materia di nuovi ingredienti alimentari. Lo scopo delle considerazioni è un tentativo di rispondere alla domanda se questa proposta offre soluzioni giuridiche sufficienti al fine di realizzare i postulati finora presentati, tenendo conto degli obiettivi di base da rispettare nella regolazione – sia quelli di protezione che di natura economica. In conclusione, l’autore rileva sia i pro che i contro delle nuove proposte. Di gran lunga il più grande vantaggio delle nuove soluzioni è quello di creare un sistema semplificato, condensato e centralizzato di autorizzazioni generali all’immissione di nuovi ingredienti alimentari sul mercato. Anche le proposte volte a creare soluzioni particolari riguardo agli alimenti tradizionali provenienti dai Paesi terzi meritano una valutazione positiva. La Commissione per la protezione dell’ambiente, la sanità pubblica e la sicurezza alimentare sostiene come tuttora molto attuale sia il problema di precisare in maniera esauriente l’ambito di applicazione del futuro regolamento in maniera tale da garantire l’univocità e l’adeguatezza delle norme in oggetto, tenendo conto da una parte del settore industriale, per il quale è molto caratteristico il livello alto di innovazione, dall’altra invece la garanzia del livello alto di tutela della salute umana, degli interessi dei consumatori e dell’ambiente naturale ma anche dell’efficace funzionamento del mercato interno.
