Nazwisko jest jednym z dóbr osobistych człowieka (por. art. 23 k.c.), a zatem jedną z wartości związanych z jednostką ludzką . Jest ono nieodłącznie związane z człowiekiem i to bez względu na stan jego psychiki i stopień wrażliwości . Nazwisko – będąc dobrem osobistym – jest atrybutem każdej osoby fizycznej , także dziecka.

The surname is an attribute of every natural person, including a child. The surname at birth (the family name) is – in fact – a surname acquired as a consequence of having been born, according to rules provided for in the Family and Guardianship Code, inseparable from a person, even after his or her death. In the regulatory environment in force since 13 June 2009, formed by the Act of 6 November 2008 on the Amendment to the Act – the Family and Guardianship Code and Some Other Acts (Journal of Laws No. 220, item 1431), the rules in question have been contained in articles 88–91 of the Family and Guardianship Code. The article examines the issue of the legitimate child’s and illegitimate child’s surname.
