"Querela nullitatis" jest instytucją złożoną. Numer 4 kan. 1620 przedstawia dwa przypadki wyroku dotkniętego wadą nieważności nieusuwalnej, które są podstawą wniesienia zaskarżenia wyroku: gdy doszło do procesu bez skargi powodowej i gdy proces nie był wszczęty przeciwko jakiejś stronie pozwanej. Przypadek pierwszy zachodzi, kiedy skargi powodowej z jakiegoś powodu nie ma. Drugi zaś jest bardziej wielowymiarowy. Wiąże się on z określeniem kto jest stroną pozwaną. Ta kwestia może czasem sprawiać trudności w procesach o nieważność małżeństwa. Dotyczy również zagadnienia nieobecności strony pozwanej w procesie. Problemem jest bowiem, jak potraktować pozwanego, który nie został wezwany z braku znajomości jego miejsca zamieszkania, a który pojawia się w sądzie po ogłoszeniu wyroku. Jakie ma w tej sytuacji prawo do wniesienia "querela nullitatis"? Wątpliwości pojawiają się również w niektórych przypadkach niezgodnego z prawem wezwania strony pozwanej bądź braku jej powiadomienia o takim wezwaniu.

"Querela nullitatis" is a complex institution. Number 4 of Can. 1620 shows two cases affected by the judgment of the indelible invalidity, which is the basis for bringing an appeal against: when it came to the process without cause complaint and when the process was initiated without defendant. The first case occurs when the cause complaint for some reason does not exist. The second one is more multi-dimensional. It is connected with determining who is a defendant. This issue can sometimes cause the difficulties in the process of nullity of marriage. It also applies to the issue of absence of the defendant in the process. The problem is in fact, how to treat a defendant who has not been invited because of the lack of knowledge of his place of residence, and who appears in court after the sentence was announced. What is in this situation, the right to bring "querela nullitatis"? Doubts also appear in some cases of illegal call of the defendant or the lack of notice of such.

"Querela nullitatis" ist eine komplexe Institution. Die vierte Nummer des Kanons 1620 zeigt zwei Fällen des Urteils mit dem unauslöschlichen Nachteil der Invalidität, der die Grundlage für die Einlegung eines Rechtsmittels betroffen ist: Prozess ohne Beanstandung des Klägers und Prozess ohne die Partei des Rechtsstreits. Der erste Fall tritt ein, wenn es keine Beschwerde des Klägers aus irgendeinem Grund gibt. Der zweite Fall ist multi-dimensional. Es wird mit der Bestimmung, wer der Beklagte ist. Dieses Problem kann manchmal zu den Schwierigkeiten im Eheprozess führen. Es gilt auch für die Frage nach der Abwesenheit des Angeklagten im Prozess. Das Problem ist, wie man einen Angeklagten, der auf die mangelnde Kenntnis seines Wohnsitzes nicht eingeladen worden ist, und der erscheint im Gericht, wenn das Urteil verkündet wird, zu behandeln. Was bedeutet in dieser Situation "querela nullitatis" zu bringen? Die Zweifeln betreffen auch illegale Vorladung oder das Fehlen einer Kündigungsfrist von solchem Angebot.
