Artykuł ukazuje problemy wiążące się z brakiem lub niedoskonałością przepisów, które definiują pojęcie i zakres dostępu do infrastruktury usługowej w Polsce i w innych państwach członkowskich Unii Europejskiej, co w dużym stopniu przyczyniło się do wprowadzenia zmian, jakie zostaną dokonane w wyniku implementacji zapisów Dyrektywy 2012/34.

The paper presents a number of problems associated with the lack of or shortcomings of current legislation that defines the notion and scope of service infrastructure access in Poland and other EU Member States. It is these problems that have largely contributed to the introduction of the changes to be made by the implementation of the provisions of Directive 2012/34.
