The European Union law contains a number of specialized acts concentrated on the topic of environment conservation. Yet, to date no comprehensive regulation concerning soil or land conservation has been written into the Community legislation. This paper presents the current legal situation, legislative work undertaken until now and main legislative issues connected with the discussed topic. This publication contains expanded analysis of the European Parliament and Council Directive on establishing framework for soil conservation and amending 2004/35/CE directive draft. The paper presents measures of the identification nature, repair mechanisms, as well as solutions aimed at increasing social awareness connected with the issue of soil conservation across the European Union. The publication contains the analysis and evaluation of new directive’s draft in the light of challenges and problems connected with current economic realities. This paper contains the description of main difficulties threatening the successful completion of legislative process.
