Artykuł przedstawia pogląd brytyjskiego filozofa konserwatywnego Rogera Scrutona na przyczyny odrzucenia przez większość wyznawców islamu reguł rządzących zachodnimi społeczeństwami i państwami. W części pierwszej artykułu prezentuje się Scrutona rozumienie konserwatyzmu oraz jego konserwatywne ujęcie problemu państwa, prawa i społeczeństwa. W części drugiej omawia się Scrutonowską interpretację prawodawstwa islamskiego oraz przyczyny, dla których pozostaje ono w niemal całkowitej sprzeczności z teorią i praktyką społeczną Zachodu. W konkluzji stawia się pytanie – częściowo polemiczne z pewną tezą Scrutona – o realne istnienie bronionej przez niego zachodniej formacji kulturowej.

The article examines the theory of Roger Scruton, contemporary British conservative philosopher, on why most Muslims reject norms governing social and political life in Western Europe. In the first part I present an overview of Scruton’s understanding of conservatism, and his conservative ideas on state, law and society. In the second part I discuss Scruton’s interpretation of the Islamic law and the reasons behind its near total opposition to and conflict with the social theory and practice in the West. I conclude with a question – partly polemical to Scruton’s thesis – as to the real existence of the Western cultural millieu he defends.
