Artykuł porusza problematykę legalności uboju rytualnego w polskim porządku prawnym, zestawiając razem zagadnienie wolności wyznania oraz prawnej ochrony zwierząt w RP. Pierwszym z omówionych zagadnień jest zasada wolności sumienia i religii w świetle prawa krajowego oraz prawa Unii Europejskiej. Następnie autorka przedstawia niektóre regulacje wprowadzone przez ustawę o ochronie zwierząt z 1997 roku oraz stanowisko Trybunału Konstytucyjnego w tym zakresie, które zestawia z normami prawnymi Unii Europejskiej. Artykuł zakończony jest uwagami de lege ferenda, w których autorka zwraca uwagę na problematykę komercyjnych ubojów rytualnych oraz niespójności prawa polskiego z prawem unijnym.

The article raises the issue of the constitutionality of the ritual slaughter in the Polish legal system. The author compared together the issue of freedom of religion and the legal protection of animals in Republic of Poland. The first of the issues is the rule of freedom of conscience and religion in national law and EU law. Next, the author presented some of the regulations introduced by the act on protection of animals of 1997 and the position of the Polish Constitutional Court, which compares with the legal norms of the European Union. An article was ended by remarks called as de lege ferenda; the author pay attention on in problems of commercial ritual slaughter and inconsistency of Polish law with EU law.
