Deregulation of urban planner profession from a perspective of jurisprudence

In May 2014 Polish parliament accepted a second part of deregulation bill including a new regulation of urban and spatial planners. The most substantial amendment is abolishment of professional self government that regulated the profession since 2001 in terms of access to profession, setting deontological and non-deontological standards of professional conduct and performing discipline. Under new regulation the only criterion to be urban and spatial planner is university degree in the field of architecture, urban policy or spatial planning, or any university degree supplemented by postgraduate studies. The paper claims, that any regulation of the profession should me aimed at protections of public interests. Although the new regulation is criticized as unconstitutional, especially by professional self government of urban and spatial planners, the paper claims that this kind of deregulation policy is consistent with article 17 of Polish Constitution. The paper analyzes the legal nature of the profession of urban and spatial planner answering if it is a profession of public trust. It considers also the scope of public tasks of professional self government of urban and spatial planners and its impact on the profession. The abolishment of the professional self government has not been preceded by analysis of this impact.
