Admissibility to depend effects of legal actions from actions dependent from will of the parties

Art. 89 of the Civil Code stipulates that commencement or the cessation of the consequences of the juridical act may be made contingent on a future and uncer-tain event (condition). Within scope of the stipulation legal doctrine and juris-prudence at the very beginning denied possibility to delineate wording of the condition in such manner that it would be dependant solely on will of the party of the juridical act due to fact that such juridical act would not be uncertain. In course of time lapse it was noticed that fulfilling of obligations rarely is certain due to dynamic changes of commercial surrounding. Performed analysis allows to confirm that it is possible to make dependant commencement or the cessation of the consequences of juridical act from activity of its party provided that such juridical act at least in part will remain non-dependant of the party.
