Exemplification of copyrightable subject matter contained in Art 1 of the Copyright Act includes „violin and similar works.” There is a dispute among legal scholars as to the nature of such works. Majority view is that there are no copyrightable violins or that the very notion is a „lawmaker’s mistake.” It is purported here that, in light of the newest developments in court practice (eg. treating perfumes as copyrightable subject matter) it would be possible to treat violin and similar instruments as copyrightable products of human creativity.
