Przedmiotem artykułu jest analiza pojęcia wykonania decyzji administracyjnej na płaszczyźnie przepisów prawa administracyjnego materialnego, procesowego jak również wypowiedzi przedstawicieli doktryny prawa. Pojęcie wykonania decyzji administracyjnej okazało się przydatne dla opisu postępowania mającego na celu ocenę realizacji decyzji administracyjnej. Do instytucji prawnych służących ocenie realizacji aktu administracyjnego zaliczamy: postępowanie w przedmiocie stwierdzenia wygaśnięcia decyzji administracyjnej, uchylenia z powodu niewykonania zlecenia oraz uchylenia lub zmiany decyzji administracyjnej na podstawie przepisów szczególnych. Instytucje te stanowią grupę wyjątków od zasady trwałości ostatecznych decyzji administracyjnych. Negatywny wynik wstępnej oceny wykonania aktu administracyjnego powoduje wszczęcie postępowania administracyjnego mającego na celu ocenę wykonania decyzji administracyjnej, co skutkuje nawiązaniem na nowo stosunku procesowego między adresatem aktu a organem administracji publicznej.

The aim of this paper is to analyse the concept of implementation of an administrative decision at the level of administrative substantive law, procedural law and also the statements by representatives of the legal doctrine. The concept of implementation of an administrative decision turned out to be useful for describing the procedure of evaluation of implementation of the administrative decision. The legal institutions used to evaluate the implementation of the administrative act include: theprocedure of expiry of an administrative decision, repeal because of non- -fulfillment of recommendation or repeal or amendment of administrative decision based on specific provisions. The negative result of the initial evaluation of the implementation of an administrative act initiates administrative proceedings, the aim of which is to assess the implementation of the administrative decision, which results in establishing a new relation process between the addressee of the act and the public administration authority.
