.W artykule autor omawia aktualne oraz projektowane regulacje prawne w zakresie stosowania klauzul społecznych w zamówieniach publicznych. Prezentowane są aktualne przepisy ustawy o zamówieniach publicznych, nowe dyrektywy (2014 rok) oraz projektowane przepisy nowej ustawy o zamówieniach publicznych (projekt z 2015 roku). Autor skupia się na tej części regulacji, która dotyczy stosowania klauzul społecznych. Choć samo pojęcie klauzul społecznych nie jest ustawowo zdefiniowane, to jednak doktryna zgodna jest, iż w istocie chodzi o te przepisy, które stwarzają zamawiającemu możliwość nałożenia na wykonawcę obowiązków w zakresie zatrudnienia przy realizacji zamówienia osób z grup defaworyzowanych. W artykule akcentuje się skalę zamówień publicznych w Polsce i dotychczasowe rozmiary stosowania klauzul. Autor dowodzi, że bez zmiany postaw osób mających wpływ na kształt ogłoszenia o zamówieniu publicznym zmieniane przepisy nie doprowadzą do osiągnięcia celu, jakim jest zmniejszenie liczby osób dotkniętych lub zagrożonych ubóstwem przy użyciu tych narzędzi.

In the article the author discusses the current and proposed legislations on the use of social clauses in public procurements. There are presented the current provisions of the Act on Public Procurement, the new directives (2014) and the proposed provisions of the new Act on Public Procurement (2015 draft). The author focuses on the part of the act which concerns the application of social clauses. Although the very concept of social clauses is not defined by act, however the doctrine agrees that, in essence, there matters the provisions which create to a contracting party the possibility to impose on a contactor the employment obligations in executing the order from people belonging to a group of disadvantaged people. The article emphasizes a scale of public procurements in Poland and the areas of the clauses application to-date. The author proves that without changing the attitudes of the persons who have an influence on the contents of the public procurement notice, the amended regulations will not lead to the achievement of the objective which is a reduction of people affected by or threatened with poverty.
