Rynek wewnętrzny Unii Europejskiej, zgodnie z jego definicją traktatową, jest obszarem bez granic wewnętrznych, w ramach którego zapewniony jest swobodny przepływ towarów, osób, usług i kapitału. Można zatem wyróżnić cztery swobody rynku wewnętrznego. Elementem swobody przepływu osób jest ponadto swoboda przedsiębiorczości (działalności gospodarczej). Istotną część rynku wewnętrznego stanowi rynek usług finansowych i wyodrębniony z niego rynek usług ubezpieczeniowych. Analiza zakresu i przedmiotu poszczególnych swobód rynku wewnętrznego oraz przedmiotu działalności ubezpieczeniowej pozwala stwierdzić, że spośród wymienionych swobód nie wszystkie będą miały zastosowanie w sektorze ubezpieczeniowym. Przedsiębiorstwa ubezpieczeniowe wykonują bowiem swoją działalność i świadczą usługi ubezpieczeniowe, w tym na zasadach transgraniczności, jedynie na podstawie swobody przedsiębiorczości i swobody świadczenia usług.

The internal market of the European Union, according to its definition contained in the Treaty, is an area without internal frontiers in which the free movement of goods, persons, services and capital is ensured. It is possible to distinguish four freedoms of the internal market. In addition, it shall be pointed out that a freedom of establishment is a part of a free movement of persons. The insurance market, as a part of the market of financial services, is a significant part of the internal market. The analysis of the extent and the subject matter of the internal market freedoms and the subject matter of the business of insurance allows to determine that not all of the freedoms mentioned will apply to the insurance sector. The insurance undertakings pursue their business activities and provide insurance services, including cross-border business of insurance and crossborder insurance services, only on the basis of the freedom of establishment and the freedom to provide services.
