Artykuł dotyczy pojęcia grupy w ubezpieczeniach grupowych. Zasadniczą tezą jest stwierdzenie, że grupa ubezpieczonych może być ubezpieczona grupowo tylko wówczas, gdy istnieje przyczyna prawna objęcia ją ochroną ubezpieczeniową przez ubezpieczającego. Może nią być wykonanie zawartej między ubezpieczającym i ubezpieczonymi umowy o objęcie ubezpieczonego ochroną ubezpieczeniową. Istotnym ograniczeniem dla budowania „grup otwartych” jest brak możliwości pobierania przez ubezpieczającego prowizji od składki ubezpieczeniowej finansowanej przez ubezpieczonego. Obowiązujące przepisy uniemożliwiają przymusową unifikację zakresu ubezpieczenia dla wszystkich członków grupy.

The article discusses the notion of 'a group' in group insurance. The fundamental thesis is that the group of insured can be insured as a group, only when there is a legal cause to cover it with insurance coverage by the insurant. It may be the execution of the contract of covering the insured with the insurance protection, concluded between the insurant and the insured. The significant limitation for the creation of open groups is the lack of the insurant's possibility to receive commission from the insurance premium financed by the insured. The regulations in force prevent compulsory unification of the scope of insurance for all the group members.
