Enterprises and banks in Poland have received new, more efficient legal and financial instruments regarding restructuration, incorporated in a new Restructuration Law. In the future the priority will be recovery, not bankruptcy of enterprises. Banks can play an important role in recovery processes of their debtor-enterprises; banks’ functions and instruments are presented in this paper. In many cases restructuration will fail without „survival capital” delivered by banks. A research conducted under supervision of the author shows how enterprises valuate hitherto banks’ support. However, the said bill has not removed all the legal barriers for restructuration.

Przedsiębiorstwa i banki w Polsce otrzymały nowe, skuteczniejsze instrumenty prawne i finansowe w zakresie restrukturyzacji w nowej polskiej ustawie Prawo restrukturyzacyjne. Priorytetem będzie w przyszłości naprawa (recovery) a nie upadłość przedsiębiorstwa. Dużą rolę w procesach naprawczych mogą spełnić banki wobec swoich przedsiębiorstw – dłużników; funkcje i instrumenty banków zaprezentowano w artykule. Bez dostarczonego przez banki „kapitału przetrwania” restrukturyzacja w wielu przypadkach nie uda się. Jak przedsiębiorstwa oceniają dotychczasowe wsparcie banków, w tym dla procesów restrukturyzacji pokazuje badanie zrealizowane pod kierunkiem autora. W dalszym ciągu istnieją jednakże bariery prawne restrukturyzacji, których wymieniona ustawa nie zniosła.
