The article deals with the proposed provisions on extraordinary mitigation of penalty in the Law of July 7, 2022 on Amendments to the Law – Criminal Code and Certain Other Laws, which was rejected by the Senate. The Law provides for extraordinary mitigation for an offender under Article 60 § 3 of the Penal Code only at the request of the prosecutor, modification of the technique of extraordinary mitigation (Article 60 § 6-8 of the Penal Code) and significant expansion of the regulation on the concurrence of grounds for extraordinary imposition of penalty (Article 57 of the Penal Code). Analysis of the draft allows us to assume that most of the proposed changes are not accurate.
