Investment permission is one of the new legal remedies introduced in the draft Urban Planning and Construction Code of 30th September 2016, and it may provide for, inter alia, decisions on the permissibility of investments in areas not covered by the local spatial development plan. This paper analyses those of regulations introduced in this bill that relate to the possibility to specify the location of an investment in the course of proceedings to grant an investment permit; it also includes a comparison between the proposed solutions and the now-in-force provisions regulating the procedure for determining zoning conditions.
