The article deals with the issues related to the compliance with the Constitution of the Republic of Poland of punishment under the criminal law of defamation (article 212 of the Penal Code) and the possibility of repealing this regulation. By a decision of 14 July 2021, the Constitutional Tribunal discontinued the proceedings under the constitutional complaint, in which the complainant, convicted for this offense, accused art. 212 and 213 of the Penal Code from art. 54 paragraph in connection with art. 31 paragraph 3 of the Constitution. The Court found that this issue had already been resolved in previous jurisprudence. However, this does not change the fact that the issue of punishment for defamation still remains doubtful and should be repealed.
