This article discusses the legal regulations associated with making court files accessible in criminal cases, particularly the media’s access to court files. The starting point of the discussion was the assumption that the access to details of criminal cases and the course of conducted proceedings is guaranteed by the Constitution of the Republic of Poland in Art. 1 and 2, which defines the right to obtain information on the activities of organs of the public authority as well as persons discharging public functions. This right also ensures access to documents. The fundamental act which characterizes the course of access to public information is the Act of 6 September 2001 on Access to Public Information. The Criminal Proceedings Code also includes regulations characterizing the course and principles of making files in criminal cases accessible. The author discusses numerous issues resulting from the interpretation of these regulations as well as their mutual relations.
