Celem niniejszego opracowania jest analiza treści wolności sumienia i wyznania zagwarantowana na podstawie przepisów Konwencji o Ochronie Praw Człowieka i Podstawowych Wolności oraz odniesienie tej regulacji prawnej do problematyki eksponowania w przestrzeni publicznej wyznania poprzez noszenie chusty islamskiej. Zagadnienie to zostanie omówione na podstawie najbardziej reprezentatywnych orzeczeń Europejskiego Trybunału Praw Człowieka w tej materii, tj. decyzji w sprawie Dehlab przeciwko Szwajcarii, wyroku w sprawie Leyla Sahin przeciwko Turcji oraz wyroku w sprawie Dogru przeciwko Francji.
The aim of the article is the analysis the content of freedom of conscience and religion as a human right which is guaranteed in the Convention for the Protection of Human Rights and Fundamental Freedoms and its application in the context of wearing a hijab in public places. The issue in question is discussed taking into consideration the most representative judgements of the European Court of Human Rights, i.e. the decision Dehlab v. Switzerland, the judgement Leyla Sahin v.Turkey and the judgement Dogru v. France.
