Ustanowienie przepisów pozwalających na zaskarżenie uchwał jednostek samorządu terytorialnego w związku z naruszeniem interesu prawnego lub uprawnienia było swego rodzaju oświadczeniem ustawodawcy, że samodzielność jednostek samorządu terytorialnego nie może być nadużywana i wychodzić poza ustawowe granice. Dlatego jednostka uzyskała ochronę prawną poprzez możliwość uruchomienia kontroli sądowej uchwał samorządu terytorialnego. Nie chodzi tu zatem o ustanowienie ochrony samorządu terytorialnego, ale innych podmiotów, których interes prawny lub uprawnienie zostało naruszone działalnością gminy, powiatu i województwa samorządowego.

Establishing the rules allowing for contesting the resolutions of local government units in connection with the violation of legal interest or entitlement was kind of a statement of the legislator that the independence of local government units cannot be misused and go beyond legal boundaries. Therefore, the entity was granted legal protection by being able to perform the judicial review of resolutions of local government.
