Z analizy przepisów dotyczących ochrony praw dziecka – art. 19 Konwencji o prawach dziecka (KOPDz) jak i art. 72 Konstytucji RP wynika, iż jakiekolwiek rozważania i badania odnoszące się do bezpieczeństwa dzieci i młodzieży muszą uwzględniać między innymi zjawiska przemocy, demoralizacji jak również zakres i determinanty ich występowania oraz uwarunkowania tych problemów, konsekwencje ich doświadczania i sposoby likwidowania. Ochrona dziecka przed krzywdzeniem dookreślona jest w wielu aktach prawnych, tak o zasięgu międzynarodowym (uniwersalnym i regionalnym), jak i krajowym, na co zwraca uwagę autor w artykule. Dokonana analiza prowadzi do wniosku, iż zadaniem państwa, w tym organu władzy publicznej, jest kształtowanie świadomości prawnej i kultury prawnej społeczeństwa oraz ochrona dziecka i zapobieganie występowaniu zjawisk, o czym stanowi art. 19 Konwencji o prawach dziecka i art. 72 Konstytucji Rzeczpospolitej Polski. Autor również wskazuje na doniosłą rolę Rzecznika Praw Dziecka w RP oraz jego uprawnienia w celu ochrony praw i dobra dziecka

This article shows that the discussion and research into the issue of child and youth safety must take account of the phenomenon of violence: especially the extent and determinants of its occurrence, the conditions of this problem as well as the consequences of experiencing violence by children. Child protection from abuse is guaranteed by a number of legal acts, both international (universal and regional) and national, which is reflected in this article. The duty of the state, and public authority as well, is to raise social awareness of legal issues, promote legal culture, prevent the occurrence of violence among children as well as guaranteeing child protection, which stems from art. 19 of the Convention on the Rights of the Child and art. 72 of the Polish Constitution. The author also stresses the importance of the role played by The Children’s Rights Advocate in Poland and the powers attributed to this particular constitutional body in the field of protection of children’s rights and welfare
