The Polish Family and Guardianship Code regulates two forms of marriage. The difference between them concerns whether the declarations of the future spouses are made to the civil status official or to the clergyman. In the latter case, the marriage is concluded only when the civil status official draws up the marriage certificate. The author criticizes this regulation, shows that it has no basis in the provisions of the concordat and postulates a change in the code provision by deleting the words concerning the drawing up of the marriage certificate.
