The article presents the issues of fundamental rights and freedom of individuals and their permissible limitations in the event of the introduction of the extraordinary state. The central point of the discussion is the constitutional standard of creating a law in the area of limiting the rights and freedom of the individual due to the occurrence of a threat resulting in the introduction of the extraordinary state. It turns out, however, that this standard raises the numerous differences in the views of the doctrine as some of the directives of the constituent names. They concern, in particular, the application of the general limitation clause of the rights and freedom of the individual, the scope of the principle of correct legislation, the limits of permissible interference in the rights and freedom of the individual due to the threat to the normal functioning of the state. The various constitutional conditions for the introduction of individual extraordinary states also affect the rules of interference in the rights and freedom of the individual. Finally, the article formulated the thesis that the catalog of directives of interference in the law and the freedom of the individual in extraordinary states includes four main groups. These are directives for the introduction of individual extraordinary situations, directives for interference in the sphere of individual rights and freedom in the event of the introduction of one of these states, general directives for permissible interference in this sphere and general directives for the correctness of law-making.
