This paper deals with the important issue arising from questionable interpreting the provisions of the Public Finance Act by the Minister of Treasury and the President of the Agency for Restructuring and Modernisation of Agriculture, concerning the ownership of shares and stock of companies that are agricultural wholesale markets and commodity exchanges. Regarding this issue, both bodies of public authority were frequently embroiled in litigation, resulting in many cases in contradictory decisions. The High Court tends to grant significant rights to the State Treasury, which may threaten the interests of the shareholders who are agricultural producers, and may also lead to dissipating significant public expenditure on the organization of the current ownership structure of wholesale markets and commodity exchanges.
