W ostatnich latach odmowa dokonania transkrypcji aktów urodzenia dzieci par jedno-płciowych coraz częściej staje się przedmiotem rozstrzygnięć Naczelnego Sądu Admini-stracyjnego oraz Sądu Najwyższego. Ten niezwykle aktualny i zarazem skomplikowany problem prawny został poddany w niniejszym opracowaniu wieloaspektowemu bada-niu. Interpretacja przepisów, regulujących kwestię wydawania aktów urodzenia, pozwo-liła na określenie ich miejsca w procesie tworzenia tożsamości dziecka. Z kolei analiza orzecznictwa dokonana w drugiej części artykułu umożliwiła wskazanie konkretnych konsekwencji odmowy przeniesienia zagranicznego aktu urodzenia do krajowego reje-stru stanu cywilnego. Najważniejszą i zarazem najobszerniejszą część rozważań stano-wi jednak odniesienie skutków prawnych przyjętych rozwiązań do podstawowych za-sad i wartości konstytucyjnych i międzynarodowych. Tak szerokie ujęcie problemu dało podstawę do sformułowania ostatecznych wniosków w kwestii słuszności podjętych przez państwo polskie działań, które miały służyć ochronie krajowego porządku prawnego.

In recent years, refusal to transcribe birth certificates of children of same-sex cou-ples has increasingly become the subject of decisions of the Supreme Administrative Court and the Supreme Court. This extremely current and at the same time compli-cated legal problem has been subjected in this study to a multifaceted study. The in-terpretation of the provisions regulating the issue of birth certificates allowed to de-fine their place in the process of creating the child`s identity. On the other hand, the analysis of the case law made in the second part of the article made it possible to indicate specific consequences of the refusal to transfer foreign birth certificate to the national register of marital status. The most important and at the same time the most extensive part of the considerations is, however, the reference of the legal effects of the adopted solutions to the basic constitutional and international princi-ples and values. Such a broad approach to the problem provided the basis for formu-lating final conclusions as to the rightness of the actions taken by the Polish state to protect the domestic legal order.
