Predatory pricing is one of the manifestations of abusing dominant position. It consists in using prices which do not include the costs of production and are intended to eliminate competition. However TFEU does not specify what behaviors of enterprises can be classified as predatory pricing. The purpose of this article is to analyze the EU case law, decisions of the European Commission and the views of doctrine in order to determine the conditions for qualifying behavior as predatory pricing.
